Expanding access to VA benefits: A critical step forward

The Department of Veterans Affairs’ recent announcement of a new grant program to fund legal assistance for veterans with other-than-honorable discharges is a significant step forward in ensuring that these deserving individuals have access to the benefits they’ve earned. However, more can be done to address the root causes of wrongful discharges to help prevent future injustices.

The Problem of Wrongful Military Discharges

Many veterans are unjustly denied VA benefits due to less-than-honorable discharges that are often the result of errors or misunderstandings. These wrongful discharges can have devastating consequences for veterans and their families, depriving them of essential services like mental health treatment and disability compensation.

The Need for Reform

While the VA’s grant program is a valuable initiative, it is crucial to address the underlying issue of wrongful discharges. Currently, commanders have enormous discretion in awarding less-than-honorable discharges, leading to thousands of mistakes that cause unnecessary hardship for veterans.

A Comprehensive Approach

While the VA’s efforts to “fix” the injustice resulting from less than honorable discharges are welcome, that’s just spending taxpayer money to respond to a problem.  What’s really needed is DoD efforts to FIX the problem.  These efforts would include:

  • Stricter Regulations: Implementing more stringent guidelines for commanders when awarding discharges;
  • Mandatory Reviews: Requiring higher level review of that Commander’s decision;
  • Legal Representation: Affording service members the right to military legal assistance to ensure the discharge complies with regulations. 

By taking these steps, we can reduce the number of wrongful discharges, save taxpayers money, and alleviate the suffering of veterans and their families.
